Precatórios are judicial instruments used for the payment of debts recognized by the Court against public entities, when there is no longer any possibility of appeal. You may be entitled to a precatório if you won an action against a public entity and the decision generated a credit related to differences in retirement benefits, wages, pensions, compensation, or tax matters.
According to lawyer Isabella Chaves, from Sonar Precatórios, precatórios may have an alimentary nature, when they arise from actions regarding wages, pensions, retirement benefits, and compensation, or non-alimentary, when they involve topics such as expropriations and taxes. The request for the precatório is issued by the body where the process was handled.
To find out if you have a precatório, the first step is to identify which process generated the credit and in which branch of the Judiciary it was processed. The inquiry should be made directly with the responsible body, whether in state or federal court, as the case may be.
