Dino, Moraes and Mendonça's actions expose 'war of single-judge rulings' at STF, professor evaluates

The professor of Criminal Law at FGV Law São Paulo, Luísa Moraes Ferreira, criticized the decision by Minister Flávio Dino, of the Supreme Federal Court (STF), which suspended the removal of the director-general of the Federal Police, Andrei Rodrigues, and determined his return to the position. For her, the decision presents procedural problems and should not have been made by one minister against another of the same Court.

In an interview with CBN Brasil, the professor evaluates that any review of the decision by André Mendonça should occur through the Second Chamber of the STF or, exceptionally, through the president of the Court, Edson Fachin. She considered it very serious that a minister of the STF, who is at the same hierarchy as another minister, simply suspended the decision of another member of the Court.

For Luísa, the same criticism made by Dino about the decision by Mendonça could be applied to Minister Dino's own decision. The professor exposed what she classified as a "war of single-judge rulings" at the STF, referring to decisions made individually by ministers rather than by the full court or chambers.
