Minister Flávio Dino, of the STF, decided on Wednesday (9) to immediately reinstate Andrei Rodrigues to the position of director-general of the Federal Police and Leandro Almada to the position of director of Police Intelligence of the corporation. The decision directly contradicted the determination of fellow minister André Mendonça, who had ordered the removal of the two on Tuesday.
Dino considered that there are serious procedural problems in the removal ordered by his colleague. The main argument is that the Novo Party would not have legitimacy to request the precautionary removal of the delegates in a criminal investigation. According to Dino, the Code of Criminal Procedure provides that precautionary measures be requested by the parties, by the police authority, or by the Public Ministry, and does not include political parties among those with standing to do so.
Dino also states that the matter should be analyzed by the STF Plenary, and not by a single-judge decision, because the president of the Court, Edson Fachin, had already included the topic on the court's agenda.
