Jurists are commenting on the conduct of Minister André Mendonça of the Supreme Federal Court (STF), who when determining the removal of the Federal Police chief, Andrei Rodrigues, used precedents from Minister Alexandre de Moraes. The procedures adopted by both are constant targets of criticism by specialists.
In the decision that removed Andrei Rodrigues, Mendonça reported that he was the subject of at least six intelligence reports produced by the PF in a classified manner, between August 3 and 31 of this year. These apocryphal documents were the main argument used by the minister to also remove Leandro Almada, number 2 of the PF.
The situation creates a confusion between the figure of the investigated and the investigator, something that was already pointed out as a problem in Moraes' conduct in the fake news inquiry, which investigates attacks on institutions and authorities. In that case, Moraes was the main target of the monitoring.
PUC-SP Law School professor Marina Faraco identified at least two conflicts in Mendonça's decision. One of them is precisely the confusion between the figure of the investigator and the investigated, in addition to the possible violation of the principle of separation of the three Powers, although the response in the article was cut off.
