Minister Gilmar Mendes, of the Supreme Federal Court, stated that there are elements that indicate the incompetence of the Second Chamber to analyze the decision of Minister André Mendonça that determined the preventive removal of the director-general of the Federal Police, Andrei Rodrigues, and the director of Police Intelligence of the corporation. Gilmar requested a view to suspend the trial on the case.
The decano of the STF questioned the fact that the measure was adopted based on a request from a political party. For him, there are doubts about the possibility of the precautionary removal having been determined based on a request from a political party, which raised controversy about the procedures adopted.
Gilmar Mendes argued that the measure occurred in apparent contrariness to the Code of Criminal Procedure and the Internal Rules of the STF. According to the minister, these norms establish requirements arising from the accusatory system, which should have been observed before the determination of the removal.
The case directly involves Andrei Rodrigues, current director-general of the Federal Police, and the director of Police Intelligence of the corporation, both preventively removed by decision of André Mendonça. The trial was suspended due to the view request by Gilmar Mendes, who will now analyze the issue before returning the case for continuation.
