Amid crisis, Gilmar Mendes proposes to prohibit police and military from working in STF offices

Minister Gilmar Mendes presented a proposal to amend the Internal Rules of the Supreme Federal Court (STF) with the objective of prohibiting the appointment or designation of military personnel from the Armed Forces and servers from police careers provided for in article 144 of the Constitution for positions in commission or commissioned functions in the offices of the ministers.

According to the proposal, federal police officers, federal highway police officers, civil and military police officers from the states, including firefighters and prison police, would be prohibited from working at the Court. The only exception provided is for security activities, as long as the head of the office informs the Court's secretariat. Even in these cases, the servers cannot participate in the investigation of inquiries or proceedings or in legal advisory activities.

Currently, two Federal Police delegates advise Minister André Mendonça, who is the rapporteur of sensitive cases at the Court, such as the Master and INSS fraud investigations. Minister Alexandre de Moraes also has two other delegates in his office.

The measure arises in the midst of the crisis involving the Bolsonaro supporters' camps in front of the Armed Forces headquarters, who are protesting against the results of the 2022 presidential elections.
