Fachin internally evaluates what to do to contain crisis at STF between Moraes and André Mendonça

STF President Edson Fachin has been internally evaluating the possibilities to contain the crisis installed between ministers Alexandre de Moraes and André Mendonça. The conflict between the two ministers arose in the context of an inquiry that investigates fraud at Banco Master, which also mentions the names of Alexandre de Moraes and Dias Toffoli.

One of the most likely alternatives would be to keep the investigation targeting ministers under the umbrella of the STF presidency, transferring the case rapporteurship to Fachin. The objective would be to preserve institutionality and avoid direct confrontations between ministers, as occurred between Moraes and Mendonça.

Another possibility evaluated is to bring the discussion about the crisis to the court plenary, rather than making any individual decision. In this sense, Fachin has been informally talking with other ministers to evaluate the possible paths.

The internal analysis indicates that the moment requires an institutional position and that the solution lies in a joint response from all Supreme Court ministers, rather than isolated decisions from the presidency.
