The president of the Supreme Federal Court, Edson Fachin, removed from the scope of the fake news inquiry the request by Justice Alexandre de Moraes to open a case against fellow Justice André Mendonça. The decision was made to separate the cases and prevent them from proceeding together in the inquiry that was already under Moraes' responsibility.
In the same decision, Fachin opened a five-day period for the Attorney General's Office to respond and, afterward, another five days for André Mendonça to respond. With this, both the accusations by Moraes against Mendonça and Mendonça's document citing conversations between Moraes and Daniel Vorcaro, of Master, will proceed in an autonomous petition.
The new petition was linked to the Presidency's chamber of the Court, meaning that Fachin himself will define the course of the case and decide when and how the cases will be brought for consideration by the other justices of the STF.
According to Fachin, the measures determined are intended exclusively for the instruction of the case, without prejudging admissibility or the regularity of the process. The decision seeks to ensure that the case follows legal procedures without any type of preliminary judgment.
