The number of new judicial actions against health insurance plans exceeded the volume recorded against the Unified Health System (SUS). According to the National Justice Council (CNJ), by June 2026, 181 thousand actions related to supplementary health had been filed, compared to 164 thousand involving the public system, a difference of 10.4%.
This data is from the CNJ's Panel of Procedural Statistics on the Right to Health and was presented by council member and president of the National Forum for the Judiciary and Health (Fonajus), Daiane Nogueira de Lira.
Elton Fernandes, a specialist attorney in health insurance plans and guest professor at the University of São Paulo, explains that the historical reversal may be related to the financial calculations of the operators themselves. According to him, one hypothesis is that some operators prefer to take the risk of being sued rather than immediately authorizing treatments included in the benefits list or contractual coverage.
