A man, the sole caregiver of his demented mother, decided to take the case to court to force his siblings to share the care of their parent. The lawsuit was filed against the remaining family members who, according to the plaintiff, have not contributed to the care of the mother.
The complaining son also asks for compensation of 30 thousand euros, a sum he says corresponds to the expenses he incurred alone over the last three years for the maintenance and care of his mother. The amount covers costs related to food, medication, assistive devices, and other expenses associated with dementia.
The court will now analyze whether there is a legal obligation for the remaining children to participate in the care and expenses of their parent. Portuguese legislation establishes that children have the duty to provide support to their parents when they are in a situation of need.
