CHEGA submitted to the Assembly of the Republic a bill that aims to strengthen the protection of those who defend themselves from serious aggression. The initiative was announced by Madeiran deputy Francisco Gomes and proposes an amendment to one of the articles of the Civil Code.
The main objective of the proposal is to remove the possibility of the aggressor demanding compensation for damages suffered during the victim's defensive reaction. This way, the aim is to prevent those who initiate aggression from benefiting from legal compensation.
The proposal provides for the exclusion of compensation in situations of non-culpable excess in self-defense. This means that, even if the defense goes beyond what is strictly necessary, but without fault on the part of the defender, the aggressor would not be entitled to any compensation.
The measure comes in a context of debate about the limits of self-defense and aims to ensure that people defending themselves from attacks are not penalized for any involuntary excess in their defensive reaction.
