The president of the Supreme Federal Court (STF), Edson Fachin, is still considering how to proceed regarding a Federal Police report that shows banker Daniel Vorcaro asking the minister Alexandre de Moraes for guidance during investigations into financial fraud at Banco Master, of which he was the controller. The document was produced from a request by Minister André Mendonça, the case rapporteur at the Court.
There are divergences between wings of the STF about the validity of the report. Allies of Mendonça argue that the document does not constitute an investigation, as it was not known in advance who the banker's interlocutor was. On the other hand, the group more aligned with Moraes and the Attorney General's Office considers the document null, since the full court should have been consulted before its preparation.
The central issue revolves around the appropriate procedure for investigating an STF minister, generating internal debates at the Court about the procedures to be followed in cases involving members of the court itself.
