The president of the Superior Electoral Court (TSE), Justice Kassio Nunes Marques, kept on air a campaign ad from President Luiz Inácio Lula da Silva that links the opposing candidate Flavio Bolsonaro to the scandal involving Banco Master. The piece was broadcast during free electoral time on Saturday, the 29th, and begins with the phrase "Banco Master, the biggest corruption scandal in Brazil".
On the same Tuesday, Nunes Marques ordered the removal of a post that used an image apparently produced by artificial intelligence showing Flavio Bolsonaro hugging banker Daniel Vorcaro, arrested in a Federal Police operation.
In two separate decisions, published on Tuesday and Wednesday, Nunes Marques defended the need for minimal intervention by electoral justice and the preservation of the right to political criticism, even when sharp or harsh.
According to the minister's rulings, the difference between the two cases lies in the existence of factual basis for the association made in Lula's ad and the use of synthetic content to place the candidate in a context from which there is no indication he participated.
