The president of the Supreme Federal Court (STF), Edson Fachin, initiated individual conversations with ministers of the Court to gauge the internal environment before deciding the fate of the investigation request involving minister Alexandre de Moraes. According to court interlocutors, Fachin began hearing his colleagues separately about the case.
The consultations occur amid internal pressure for Fachin to avoid deciding alone on an issue that divides the Court. One of the alternatives discussed is to bring the request to the collegiate body, even if there is no majority among the ministers for opening an investigation against Moraes.
Rapporteur of the case, minister André Mendonça asked that the case be analyzed by the collegiate body. In this reading, a collective decision would allow the Supreme Court to give an institutional response to the episode and divide among the members of the Court the burden of a definition on the case.
Fachin can either dismiss the request or submit it for analysis by the collegiate body. The case involves a request for investigation against Alexandre de Moraes, and the outcome depends on the conversations the president of the STF still intends to have with the other ministers.
