The Superior Electoral Court will rule on Tuesday on an action questioning the use of artificial intelligence to reproduce former President Jair Bolsonaro's image and voice. The video was broadcast during the convention that formalized Flavio Bolsonaro's candidacy for President by PL.
The action was filed by the Brazil Hope Federation, formed by PT, PCdoB, and PV. The video showed Jair Bolsonaro declaring support for his son's candidacy, generating discussion about the use of so-called "deepfake" in elections.
The president of TSE, Justice Kassio Nunes Marques, met with the Court members behind closed doors last week in an attempt to build consensus on the topic before bringing concrete cases to the floor. The meeting ended without consensus among the members.
The rule imposed by the Court prohibits the use of synthetic content in audio or video, whether to favor or harm candidacies, including any digitally manipulated material to replace or alter image or voice. The ruling is expected to establish parameters on what constitutes deepfake in the electoral context.
