The Superior Electoral Court will analyze on Tuesday the use of a video produced with artificial intelligence by Flavio Bolsonaro's campaign. The action was filed by PT against the material that reproduced the image and voice of former President Jair Bolsonaro during the PL convention that confirmed Flavio's candidacy for the presidency of Brazil.
The ruling is expected to establish which contents produced or altered by artificial intelligence should be classified as deepfake. The court's internal trend, following the previous understanding adopted when creating the rules for the use of AI in elections, is to maintain the prohibition on content capable of inducing the voter to believe that a certain fact actually occurred, regardless of whether the material benefits or harms a candidate.
One of the possibilities for analyzing the case lies in the proof of deepfake use. The court should use the ruling to reestablish the guidelines on the limits of the use of this type of technology in elections.
