The Federal Court ordered the release of Chilean Germán Andrés Naranjo Maldini, arrested in May for making racist and homophobic comments aboard a Latam Airlines plane. The decision was made by Judge Fabiana Alves Rodrigues, from the 1st Federal Court of Guarulhos, who ordered the use of an electronic ankle monitor and restricted the Chilean's movement to Greater São Paulo.
On May 15, the Chilean was on a flight departing from São Paulo bound for Frankfurt, Germany, when he offended airline flight attendants. He said one flight attendant had "the smell of a Black Brazilian" and stated that being gay "is a problem," among other insults against homosexuals.
The defense claims that Germán Naranjo has psychiatric issues and requested the establishment of a mental insanity proceeding. The process was initiated so that the Court can decide whether he has conditions that lead to the non-imputability of the foreigner.
The Chilean man's lawyers continue to act in the case, and the process that will analyze the question of his criminal responsibility is still ongoing in Brazilian judicial spheres.
