Woman forced to return €12,706.87 to Social Security for receiving widow's pension for 2 years without entitlement as first wife of deceased: court 'confirmed'

A woman who received for more than two years part of her ex-husband's widow's pension will have to return €12,706.87 to Spanish Social Security. The Superior Court of Justice of Andalusia confirmed the obligation to return the money, although the beneficiary claimed to have acted in good faith and correctly informed the organization about her situation.

The first wife was married to the deceased between 1968 and 1988, about 20 years. After the divorce, the man remarried and remained with the second wife until he died in February 2010. In 2016, the National Social Security Institute recognized the first wife's right to a part of the widow's pension, calculated according to the duration of the marriage, which caused a reduction in the amount received by the second wife.

The widow did not agree with the reduction and went to court, which ultimately recognized that she was entitled to receive 100% of the pension. Social Security initially claimed the return of €16,869.68 for payments made between 2016 and 2018. Although Labour Court No. 5 of Córdoba ruled in favor of Social Security, the higher court reduced the amount to €12,706.87, dismissing interest and surcharges because the organization failed to explain the calculation method.

The judges recognized that the improper payment resulted from the organization's own decision, but considered that the administrative error did not eliminate the legal obligation to return the money. The court recalled that Article 55 of the Spanish General Social Security Law obliges those who received improper benefits to return the respective amounts, and that the reference to good faith in that provision applies only to the subsidiary liability of third parties, not excluding the direct liability of the recipient of the benefit.

Uma mulher que recebeu durante mais de dois anos parte da pensão de viuvez do ex-marido terá de devolver 12.706,87 euros à Segurança Social espanhola. Embora tenha informado o organismo e alegado que agiu de boa-fé, o tribunal concluiu que o montante foi pago indevidamente, uma vez que a segunda mulher do falecido tinha direito à totalidade da prestação.

O caso foi analisado pelo Tribunal Superior de Justicia de Andalucía, que confirmou a obrigação de restituir o dinheiro. Segundo o jornal digital espanhol Noticias Trabajo, a boa-fé da beneficiária não foi suficiente para afastar a dívida.

Primeiro casamento durou cerca de 20 anos

A mulher esteve casada com o falecido entre 1968 e 1988. Depois do divórcio, o homem voltou a casar e permaneceu com a segunda mulher até morrer, em fevereiro de 2010.

Em 2016, o Instituto Nacional de la Seguridad Social reconheceu à primeira mulher o direito a uma parte da pensão de viuvez, calculada de acordo com a duração do casamento. Esta decisão provocou uma redução no valor que estava a ser recebido pela segunda esposa.

Segunda esposa reclamou totalidade da pensão

A viúva não concordou com a redução e avançou para tribunal. A Justiça espanhola acabou por reconhecer que tinha direito a receber 100% da pensão de viuvez, sem a divisão anteriormente determinada pela Segurança Social.

A decisão obrigou o organismo a rever os pagamentos efetuados à primeira mulher. A Segurança Social reclamou inicialmente a devolução de 16.869,68 euros, relativos às quantias pagas entre 2016 e 2018.

Boa-fé não afastou obrigação de devolver

Numa primeira fase, o Tribunal do Trabalho n.º 5 de Córdova deu razão à Segurança Social e determinou a devolução integral dos 16.869,68 euros. A ex-mulher recorreu, defendendo que tinha comunicado corretamente a sua situação e recebido a pensão de boa-fé.

O tribunal superior recordou, contudo, que o artigo 55.º da Lei Geral da Segurança Social espanhola obriga quem recebeu prestações indevidas a restituir os respetivos montantes.

Erro da Segurança Social não eliminou dívida

Os juízes reconheceram que o pagamento resultou de uma decisão do próprio organismo, que inicialmente atribuiu a prestação à primeira mulher. Ainda assim, consideraram que esse erro administrativo não eliminava a obrigação legal de devolver o dinheiro.

A referência à “boa-fé comprovada” prevista no artigo 55.º aplica-se à responsabilidade subsidiária de terceiros que tenham contribuído para o pagamento indevido. Segundo o tribunal, essa proteção não afasta a responsabilidade direta da pessoa que recebeu a prestação.

Tribunal retirou juros e reduziu montante

Apesar de confirmar a existência da dívida, o Tribunal Superior de Justiça da Andaluzia deu parcialmente razão à mulher. O montante a restituir foi reduzido de 16.869,68 para 12.706,87 euros.

De acordo com a sentença divulgada pelo Poder Judicial espanhol, o valor mais baixo correspondia ao capital efetivamente recebido. Os juros e acréscimos foram afastados porque a Segurança Social não explicou o método de cálculo nem indicou a percentagem aplicada.

Ex-cônjuge também pode receber pensão em Portugal

Em Portugal, a prestação correspondente chama-se pensão de sobrevivência. O Guia Prático da Segurança Social prevê que um ex-cônjuge possa ter direito à pensão quando recebia uma pensão de alimentos da pessoa falecida.

O Decreto-Lei n.º 322/90 estabelece que a percentagem é de 60% quando existe um cônjuge ou ex-cônjuge com direito e de 70% quando há mais do que um. Neste último caso, o valor é repartido em partes iguais, mas a parcela do ex-cônjuge não pode ultrapassar a pensão de alimentos que recebia à data da morte.

Montantes indevidos também têm de ser devolvidos em Portugal

Se surgir um novo titular com direito, a legislação portuguesa prevê um novo cálculo e uma nova repartição da pensão. Uma alteração posterior pode, por isso, modificar os valores anteriormente reconhecidos pela Segurança Social.

O Decreto-Lei n.º 133/88 determina que o recebimento indevido de prestações da Segurança Social dá lugar à obrigação de restituir o respetivo valor, de acordo com o artigo 1.º, n.º1. A decisão dependeria, porém, das circunstâncias concretas e das regras aplicáveis à anulação ou alteração do ato que atribuiu inicialmente a prestação.
