Return Law passes Constitutional Court. Decision in Seguro's hands

ZAP Notícias29 August 2026 at 06:40

The Constitutional Court found no unconstitutionalities in the eleven norms of the so-called Return Law submitted for preventive scrutiny by António José Seguro. The decision was made unanimously.

The norms in question allow for extending detentions and removing minors from the national territory. The President's doubts focused on some of the most sensitive changes provided for in the decree, namely the length of detention.

Seguro had requested the Constitutional Court's intervention on August 7. With the constitutional doubts resolved, controversy remains over the bill's rules.

The bill now returns to the President of the Republic, who can enact it or exercise a political veto.
