Justice Kassio Nunes Marques declared himself disqualified from participating in Tuesday's trial at the Supreme Federal Court. Following this decision, Dias Toffoli took the same path and stated that he would not feel comfortable deliberating on the case involving his colleague Alexandre de Moraes.
Toffoli clarified that his decision was not based on a formal disqualification, but rather on a matter of personal conscience. According to him, he would not participate in the deliberation due to a matter of personal conscience.
The case in question involves Justice Alexandre de Moraes. Toffoli had previously been the reporting justice in a proceeding related to the Master company before the case reached Justice André Mendonça.
