Minister Edson Fachin opened the session of the Supreme Federal Court asking the Court to face a difficult moment in its history. He recalled that people are not being judged, but rather facts and legal issues, and emphasized that disagreement is legitimate, but personal confrontation is not accepted.
Fachin indicated that preliminary matters of the case will be discussed first before any analysis of the merits. He reinforced that the merits are not anticipated before the procedural validity is resolved.
The president of the Court stated that the Presidency and the Plenary have the duty to conduct the Tribunal preserving its independence, collegiality, authority, and fidelity to the Constitution. He also said that the decision belongs to the Plenary, not to an individual minister.
Fachin spoke briefly with each of the ministers and with those he succeeded, seeking to give institutionality to the tense moment the Court is going through.
