The trap of asking the Tax Authority, a risky solution

This opinion article analyzes the risks associated with the Binding Information mechanism in Portugal, a tool that allows taxpayers to obtain a binding interpretation of tax rules from the Tax Administration (AT). The author argues that, despite initial good intentions, the massive issuance of Binding Information has generated more problems than solutions: the AT frequently issues contradictory positions on the same topics, creating confusion instead of clarity; arbitration courts have annulled assessments based on incorrect Information; and the direct recipients of such incorrect Information have few defense options, unlike taxpayers who simply receive corrections from the AT. The author warns that the mass publication of Binding Information with incorrect interpretations paralyzes the entire market, affecting companies that never requested the information, and cites examples such as the 6% VAT rate on urban rehabilitation and VAT exemption on investment fund management services. He concludes that companies and tax advisors should carefully weigh the risks before using this mechanism.
