The Court of Justice of the European Union (CJEU) concluded that the Supreme Court of Justice (STJ) violated European law in a sufficiently serious manner in a 2009 ruling, related to workers dismissed by TAP 33 years ago.
This CJEU conclusion means that the Portuguese State is now obliged to compensate the workers affected by the collective dismissal that occurred at TAP more than three decades ago.
The CJEU analysed the case and found that the STJ's 2009 decision did not correctly respect European law, which constitutes a sufficiently serious violation that allows the workers to seek compensation.
The case reached the Court of Justice of the European Union following an appeal that questioned the conformity of the Portuguese decision with European legislation, culminating in this condemnation of the Portuguese State.
