The National Association of State Magistrates (Anamages) filed a request with the Supreme Federal Court to guarantee the payment of a salary additional called "Career Seniority Value Portion" (PVTAC) to retired judges and pensioners. The entity argues that the STF Plenary recognized the right to this indemnification payment during a trial held in March, but that an error in the drafting of the ruling prevented the benefit from being automatically extended to this group.
The PVTAC is a 5% additional on salary for every five years of proven legal activity, which can reach up to 35% of the salary. This benefit was instituted for magistrates and members of the Public Ministry and was one of the indemnification payments approved by the STF during the trial on the matter.
The motion was sent to Justice Flávio Dino, the rapporteur of the case at the court. The association maintains that the ruling did not expressly recognize the right of retired magistrates and pensioners of magistrates to receive the payment, even after the Plenary recognized the legality of the additional.
Anamages asks that the text of the ruling be corrected so that the Courts of Justice of all states are required to extend the PVTAC to inactive judges and their pensioners, guaranteeing equality with magistrates in active service.
