The Supreme Federal Court decided to dismiss an action that challenged the possibility of using private cars for practical driving lessons and the road test for obtaining the National Driver's License. The action was filed by the National Federation of Workers in Transport and Logistics, which argued that the use of vehicles without adaptations would be incompatible with the Brazilian Traffic Code.
The issue was analyzed by Minister Cármen Lúcia, the reporting judge in the case. According to her, before any discussion about the Constitution, it would be necessary to verify whether the challenged resolution complies with other laws governing traffic, such as the CTB itself.
Based on this analysis, the STF concluded that it was not appropriate for it to review the request and decided to dismiss the action. As a result, Resolution 1,020/2025, which allows the use of private vehicles in driver training and the practical road test, remains valid and in effect.
