The Spanish Supreme Court, through the Contentious-Administrative Chamber, decided to suspend the electoral effects of the so-called 'grandchildren's law,' which allowed the granting of Spanish nationality to descendants of Spanish exiles living abroad. This decision comes within the framework of an appeal filed by the Vox party and the organization Iustitia Europa.
However, the Supreme Court did not fully meet the measures requested by these entities, which sought to prevent an increase in the electoral roll and frustrate the voting rights derived from the granting of Spanish nationality under this law.
The suspension will not apply to those who obtain from consular registries a certification that attests to their status as "born outside Spain, of a father or mother, grandfather or grandmother, who were originally Spanish and who had suffered exile."
The court thus establishes the requirement for consulates to verify and certify that applicants are effectively descendants of Spanish exiles, before electoral rights associated with nationality are recognized to them.
