The Social Court number seven of Bilbao condemned a company for using artificial intelligence as a pretext to fire a worker. The magistrate considered that the dismissal of an engineer from the company GHI Hornos Industriales was improper, since the company only generically cited the disruption of new technologies without evaluating their real impact.
The court concluded that GHI Hornos Industriales did not have the capacity to determine if process automation had truly made obsolete the job position that the corporation wanted to eliminate. This lack of concrete analysis was one of the determining factors for the judicial decision.
As a result of the condemnation, the company will have to pay compensation of 12,330.56 euros to the worker affected by the dismissal considered improper.
