Habib's: high interest rates are not the only cause of judicial recovery

The number of judicial recovery requests soared in 2026 in Brazil. Among the most recent cases are large companies such as Casas Bahia, Marabraz, Braskem, GPA, Havanna, Grupo Gennius and several agribusiness companies.

Specialists point out that it is not possible to attribute this increase solely to high interest rates. According to Camila Nicolau Juliano, a lawyer specializing in Corporate and Contract Law, the causes are a combination of several factors, including high interest rates, restricted credit, high debt levels, rising costs, changes in consumption habits, and the particular business model of each company.

Within the judicial recovery scenario, there are different profiles of companies in difficulty. Some are economically viable but are being suffocated by high interest rates. Others have outdated business models that have not adapted to market changes. There are also companies that accumulated debt during periods of cheap credit and now cannot meet their commitments.

Judicial recovery is only granted by the Court for companies that demonstrate real economic viability, meaning they can prove they have the conditions to recover and continue operating after renegotiating their debts.
