Constitutional Court gives green light to decree on asylum granting and return of foreigners

The Constitutional Court considered today constitutional the norms of the diploma that alters the granting of asylum and return of foreigners. The decision was made after the analysis of the document submitted to preventive monitoring.

The decree in question addresses changes in the rules regarding the granting of asylum, as well as in the return procedures for foreigners in an irregular situation. These changes are part of a broader revision of migration legislation.

The Court evaluated that the presented norms do not violate the constitutional principles in force, thus giving green light to its implementation. The decision was officially communicated after the deliberation of the body.

With this approval, the diploma may now enter into force, following the usual procedures for publication and implementation. The full text of the Constitutional Court's decision will be made available soon.

The Livre party announced that it respects the decision of the Constitutional Court that considered constitutional the norms of the diploma on granting asylum and return of foreigners, but reiterated its criticisms of the law. Deputy Paulo Muacho stated that the fact that the CC did not declare the law unconstitutional does not mean it is a good law, highlighting concerns about the possibility of detention and expulsion of migrant children. The party also believes there is room for political veto by the President of the Republic. The CC decision came after Marcelo Rebelo de Sousa requested preventive review of the decree approved by the Assembly of the Republic in July, which includes the extension of the temporary installation period to 180 days, possibility of separation of parents and children, and expulsion of minors.
