Livre respects Constitutional Court decision, but maintains criticism of asylum law

After the Constitutional Court considered constitutional the norms of the diploma that changes the granting of asylum and return of foreigners, the Livre party announced that it respects the decision, but does not agree with it and maintains its criticisms of the law. In a statement, Deputy Paulo Muacho stated that the fact that the Court did not consider the Law unconstitutional does not mean it is a good Law or desirable.

Livre fully maintains the criticisms it presented to this Law, namely regarding its inhumanity when it provides for the possibility of detention and expulsion of migrant children. The party also said it believes there is room for political veto by the President of the Republic.

The CC decision comes following a request from the President of the Republic, who on the 7th requested preventive review of this decree from the Assembly of the Republic, approved in July with votes in favor of PSD, IL and CDS-PP and the abstention of Chega.

The norms evaluated by the CC included the extension of the placement period for foreign citizens in temporary installation centers to a maximum of 180 days (extendable for an equal period), the possibility of separation of parents and children, the expulsion of minors from national territory, and changes to the effect of the appeal of administrative acts unfavorable to applicants and beneficiaries of protection.

Depois do Tribunal Constitucional ter considerado constitucionais as normas do diploma que altera a concessão de asilo e retorno de estrangeiros, o Livre admitiu que apesar de respeitar a decisão do TC, não concorda com a mesma e mantém as críticas à lei.

Em comunicado, o deputado Paulo Muacho referiu que: “O Livre respeita a decisão do Tribunal Constitucional, não obstante discordar da mesma. Porém, o facto de o Tribunal não ter considerado a Lei inconstitucional não significa que esta seja uma boa Lei ou que seja desejável. Por isso, o Livre mantém integralmente as críticas que apresentou a esta Lei, nomeadamente quanto à sua desumanidade quando prevê a possibilidade de detenção e expulsão de crianças migrantes”.

Além disso, o partido disse entender “que há margem para veto político do Presidente da República”.

A decisão do TC surge na sequência do pedido do Presidente da República, que no passado dia 7 solicitou a fiscalização preventiva deste decreto da Assembleia da República, aprovado em julho com votos a favor de PSD, IL e CDS-PP e a abstenção do Chega.

As normas que foram avaliadas pelo TC incluíam questões relacionadas com o alargamento do prazo de colocação de cidadãos estrangeiros em centros de instalação temporária para um período máximo de 180 dias (prorrogáveis por igual período), a possibilidade de separação de pais e filhos, a expulsão de menores de território nacional ou a “alteração do efeito normal atribuído à impugnação dos atos administrativos desfavoráveis aos requerentes e aos beneficiários de proteção”.
