Constitutional Court gives green light to decree on asylum granting and return of foreigners

The Constitutional Court considered constitutional the norms of the diploma that modifies the granting of asylum and the return of foreigners. The decision was made unanimously by the court's members.

The diploma in question was sent by the President of the Republic for preventive oversight, which means that the head of state requested the court to verify the conformity of the norms with the Constitution before promulgating the law.

The Constitutional Court ruled on the norms of the diploma that regulates both the granting of asylum and the return of foreigners, thus validating the legislative text approved by the legislative power.

Livre respects Constitutional Court decision, but maintains criticism of asylum law

The Livre party announced that it respects the decision of the Constitutional Court that considered constitutional the norms of the diploma on granting asylum and return of foreigners, but reiterated its criticisms of the law. Deputy Paulo Muacho stated that the fact that the CC did not declare the law unconstitutional does not mean it is a good law, highlighting concerns about the possibility of detention and expulsion of migrant children. The party also believes there is room for political veto by the President of the Republic. The CC decision came after Marcelo Rebelo de Sousa requested preventive review of the decree approved by the Assembly of the Republic in July, which includes the extension of the temporary installation period to 180 days, possibility of separation of parents and children, and expulsion of minors.
