Constitutional Court gives green light to Return Law and rejects Seguro's doubts

The Constitutional Court (TC) decided, unanimously, that the so-called Return Law contains no unconstitutional norms, thus setting aside the doubts raised by the President of the Republic, António José Seguro, about the new regime applicable to the departure and expulsion of foreign citizens. The decision was announced this Friday by the TC plenary, after the Head of State had sent the legislation for subsequent monitoring. António José Seguro had expressed reservations about the constitutional conformity of some aspects of the new legal regime. The TC ruled on all the issues raised by the President of the Republic, fully validating the legislation in question. This decision by the Constitutional Court allows the Return Law to enter into force, which establishes new rules for the expulsion and departure of foreign citizens in an irregular situation in Portugal.

Livre respects Constitutional Court decision, but maintains criticism of asylum law

The Livre party announced that it respects the decision of the Constitutional Court that considered constitutional the norms of the diploma on granting asylum and return of foreigners, but reiterated its criticisms of the law. Deputy Paulo Muacho stated that the fact that the CC did not declare the law unconstitutional does not mean it is a good law, highlighting concerns about the possibility of detention and expulsion of migrant children. The party also believes there is room for political veto by the President of the Republic. The CC decision came after Marcelo Rebelo de Sousa requested preventive review of the decree approved by the Assembly of the Republic in July, which includes the extension of the temporary installation period to 180 days, possibility of separation of parents and children, and expulsion of minors.
