Portugal's Constitutional Court decided that the Return Law is not unconstitutional. The judges announced that they chose "not to rule on the unconstitutionality" of the legislation, thus rejecting the arguments presented by those who questioned the law.
The preventive oversight was requested from the court in early August by politician José Seguro, who questioned the constitutionality of various aspects of the legislation.
The Return Law allows Portuguese emigrants to return to the country, offering tax incentives and other advantages for those who decide to settle again in Portugal after a period of residence abroad.
With this decision, the law remains in force and emigrants who wish to return can continue to benefit from the conditions provided by the legislative act.
