Constitutional Court is unanimous: norms of the Return Law are not unconstitutional

The Constitutional Court made a unanimous decision by declaring that the norms of the Return Law are not unconstitutional. This decision confirmed the legal validity of the contested provisions.

The court had a mandatory deadline to rule on the matter, having to issue its opinion by the last day of August. This was a decision of a mandatory nature within the established legal calendar.

The intervention of the Constitutional Court came following a concern of the President of the Republic, who considered that the Return Law raised "founded doubts" regarding its conformity with the Constitution. This assessment by the head of State triggers the mechanism of preventive monitoring of constitutionality.

Livre respects Constitutional Court decision, but maintains criticism of asylum law

The Livre party announced that it respects the decision of the Constitutional Court that considered constitutional the norms of the diploma on granting asylum and return of foreigners, but reiterated its criticisms of the law. Deputy Paulo Muacho stated that the fact that the CC did not declare the law unconstitutional does not mean it is a good law, highlighting concerns about the possibility of detention and expulsion of migrant children. The party also believes there is room for political veto by the President of the Republic. The CC decision came after Marcelo Rebelo de Sousa requested preventive review of the decree approved by the Assembly of the Republic in July, which includes the extension of the temporary installation period to 180 days, possibility of separation of parents and children, and expulsion of minors.
