TJ-SP declares amendment to the 2024 Zoning Law unconstitutional

The Court of Justice of São Paulo declared, by majority vote of the Special Body, the unconstitutionality of the amendment to the Zoning Law signed by Mayor Ricardo Nunes in July 2024. The decision, made after an action by the Public Ministry, determines that the construction rules of the legislation approved in January 2024 will take effect again, affecting what can be built on thousands of properties in the capital. The magistrates understood that the revision included amendments and new articles without the mandatory public hearings being held. The suspension is not immediate, taking effect from the publication of the ruling, and developments already licensed under the July law will not be annulled. The Zoning Law regulates parameters such as building height, types of properties, and activities permitted in each area of the city.
