Constitutional Tribunal concludes that return law respects the Constitution

The Constitutional Court decided this Friday, unanimously, not to declare unconstitutional the so-called return law, which addresses the granting of asylum, detention, and return of foreigners.

The law had been approved in Parliament on July 17. In early August, the President of the Republic requested preventive oversight of the law from the Constitutional Court.

António José Seguro considered that some of the legislative solutions in the decree raise serious doubts about the protection of the best interests of the child.

In particular, the President identified concerns about the possibility of separation between parents and children or the indirect or consequential expulsion of minor Portuguese children. The news was being updated.

O Tribunal Constitucional (TC) decidiu esta sexta-feira, por unanimidade, “não se pronunciar pela inconstitucionalidade” da chamada lei do retorno, que versa sobre a concessão de asilo, detenção e retorno de estrangeiros.

O diploma tinha sido aprovado no Parlamento a 17 de julho.

No início de agosto, o Presidente da República pediu ao Tribunal Constitucional a fiscalização preventiva do diploma.

António José Seguro considerou que “algumas das soluções legislativas deste decreto levantam fundadas dúvidas quanto a saber se é acautelado o interesse superior da criança”, em particular se possibilita a separação entre pais e filhos ou a “expulsão (embora indireta ou consequencial) dos filhos menores portugueses”.
