The Supreme Federal Court postponed on Thursday (the 27th) the resumption of the ruling on the validity of Labor Court decisions that recognized employment relationships between app-based drivers and digital platforms, the so-called phenomenon of "uberization." The new date for the analysis of the case has not yet been defined.
The ruling was scheduled for Thursday's session but was not initiated because the Plenary gave priority to another case: the analysis of the Civil Rights Framework for the Internet (Law 12,965 of 2014), which deals with the storage of users' traffic data by internet service providers.
The "uberization" case involves two actions reported by Justices Edson Fachin and Alexandre de Moraes. The proceedings reached the Supreme Court through appeals filed by the platforms Rappi and Uber, which contest Labor Court decisions that recognized employment relationships with drivers and delivery workers.
