Court annuls changes to the Zoning Law in São Paulo
The Court of Justice of São Paulo declared unconstitutional, by majority vote, the amendment to the Land Subdivision, Use and Occupation Law approved by Mayor Ricardo Nunes in July 2024. The Special Body of the TJ-SP accepted the request from the Public Ministry and decided that the law was approved by the Municipal Chamber without the required prior public hearings, with amendments and new articles added without the necessary transparency for this type of urban planning regulation. With the decision, the construction rules from the law sanctioned in January 2024 come back into effect, directly affecting the rules for construction and installation on thousands of properties in the capital. The suspension is not immediate, taking effect only from the publication of the ruling, and already licensed developments will not be invalidated.
